This was a suit by the appellee against the appellant upon a note in these words:

“$220.00. ' Stilesville, Sept, ist, 1867.
“ Six months after date, I promise to pay A. Mondy (for *29Wm. Mondy) or order, two hundred and twenty dollars, with interest at ten per centum per annum. Value received, without any relief whatever from valuation or appraisement laws.

A. Heavenridge.”

The complaint contained two paragraphs. The first was in the ordinary form upon the above note. The second alleged that on the 1st day of Sept, 1867, one William Mondy being then and there indebted to the plaintiff in the sum of…
