For present purposes we may treat the following as the undisputed facts of the case: In February, 1863, Thomas C. Nichols executed a deed, absolute on its face, conveying the land which is the subject of controversy ■to the defendant, George W. Thompson, and soon thereafter .entered the army, where he remained until his death in January, 1864. He left surviving him as his widow the plaintiff, Mibra, (since intermarried with George W.
