MEMORANDUM OPINION

ELLIS, District Judge.

INTRODUCTION

In this case, a former civilian employee of the Department of the Army in South Korea claims that the Army and his former supervisor violated his constitutional and common law rights. The alleged violations arose out of a single incident — the noncon-sensual testing of plaintiff by Army doctors for the Human-Immunodeficiency Virus (HIV), commonly known as the AIDS virus, and the limited disclosure of the results.
