On the 6th day of January, 1923, the defendant in error, Birdie Cole, as plaintiff, brought her action in the district court of Garfield ctounty against the plaintiff in error, A. W. West-lake, as defendant, to recover damages alleged to have been sustained in a collision with plaintiff in error’s automobile at the intersection of Main and Van Burén streets in the city of Enid. Parties will be hereinafter referred to as they appeared in the trial court.
