OPINION AND ORDER
SELYA, District Judge.
The United States brought this contract action to recapture unliquidated progress payments and inventory recovery costs from the defendant Lincoln Engineers, Inc. (Lincoln). Suit was filed on February 4, 1983. Lincoln answered, then moved for judgment on the pleadings, Fed.R.Civ.P. 12(c). In July of 1983, while that motion was pending, the First Circuit rendered its decision in United States v. Hughes House Nursing Home, 710 F.2d 891 (1st Cir.1983).
