This was an action for damages for personal injuries inflicted prior to statehood commenced by the defendant in error, plaintiff below, against the plaintiff in error, defendant below, on the 22d day of January, 1908, subsequent to statehood, in the district court of Comanche county. The parties will hereafter be called plaintiff and defendant as they were designated in the court below.
