Application under section 2709, Code of Civil Procedure, directing the Union Savings Bank to turn over to the consul-general of Italy, for the purpose of administration, certain moneys in thé possession of said bank, belonging to decedent, an Italian subject who died in this country intestate.

The consul-general of Italy applies to this court for a decree under section 2709 of the Code, directing the *197Union Savings Bank of Westchester to turn over to- him for the purpose of administration and payment of debts and export of the surplus of the next of kin, who are subjects of the Kingdom of Italy, certain -moneys in the possession of said bank belonging to the decedent, an Italian subject who died in this county intestate-
