MYRON H. THOMPSON, District Judge.
This case is now before the court on the plaintiff Fan Fare, Inc.’s October 28, 1982, motion for new trial. In that motion Fan Fare raised a number of grounds for new trial, but in its briefs of November 10, November 29, and December 10, 1982, has urged essentially that the court erred by requiring the jury to find the existence of agency under two counts of the complaint as a prerequisite to recovery against two of the defendants. 1 For the following reasons the motion is due to be denied.
