Pierre Paul Joseph injured his back while working as a laborer for United Dominion Construction, Inc. (“UDCI”) at Hess Oil Virgin Islands Corporation’s (“HOVIC”) oil refinery on St. Croix. Joseph sued HOVIC, alleging that his injury was caused by HOVIC’s negligence in failing to provide him with the proper equipment to safely perform his job. HOVIC moved for summary judgment, asserting that it was not liable because UDCI was an independent contractor that decided which equipment Joseph used.
