MEMORANDUM OPINION AND ORDER
This summary judgment motion requires us to decide whether, under the circumstances of this case, a landowner is liable for its own negligence that results in physical harm to the employee of an independent contractor. As a general rule, where a landowner retains control over any aspect of the contracted work, it may be liable for negligently exercising that control.
