This is an appeal from probate court, where the Arkansas Department of Human Services sought reimbursement for medicaid payments made to Jerome Morgan. Morgan counterclaimed in tort against another branch of the state, the University of Arkansas at Pine Bluff. The trial court ordered the medicare reimbursement to DHS and dismissed the counterclaim for lack of subject matter jurisdiction. On appeal, Morgan challenges both the reimbursement order and the dismissal of the counterclaim as improper. We find no merit in appellant’s argument.
