Appellant Howard Skaggs entered into a compromise settlement with appellee Charles Cul-lipher to avert litigation of a will contest. Skaggs and Cullipher were subsequently appointed co-administrators of the estate. Skaggs sought to bring wrongful-death and survival actions against Cullipher some nine months after petitioning that the estate be closed, but prior to completing ah steps necessary to close the estate.
