In June, 1910, N. Frey, Limited, having a government contract for certain levee construction in the parish of Pointe Coupee, La., called upon the plaintiff firm in New Orleans, with a view of purchasing an equipment consisting of two locomotives and a lot of dump cars. A. Marx & Sons agreed to act as brokers, to locate a suitable equipment, and put N. Frey, Limited, into communication with th'e owner of it. The result was that, on the 15th of August, 191.0, N.
