This is an appeal by the defendant from a judgment in favor of the plaintiff. The appeal was taken within sixty days after the rendition of judgment, and the evidence is brought up by a bill of exceptions.
The action is upon a contract alleged to have been executed by the high-school board of the Santa Barbara High-School District, in August, 1899. The theory of the plaintiff is, that the school trustees, constituting the board of education of the city of Santa Barbara, upon their coming into office under the charter of that city, adopted in 1899, succeeded to all the rights and obligations…
