DRUMAIOND, District Judge.

The defendant was indicted under the 21st and 22d sections of the post office act of Alarch 3, 1825 (4 Stat. 107-109), for stealing from the mail a packet containing a land warrant, and fifty dollars in bank notes. It appeared that the offense was committed near Dixon, on the 1st of August, 1850. The packet was mailed at Freeport on the 30th of July, addressed to Dixon. On the day the offense was committed, the defendant was arrested at the latter place, and a few days after-wards, a preliminary examination took place there before an officer. The defendant was…
