State v. Wilson

Appeal from Harvey District Court. At the September Term, 1879, of the district court, the appellant, Wilson, charged with the murder of one Benjamin Ball, was tried therefor, found guilty of murder in the second degree, and sentenced to fifteen years’ imprisonment in the state penitentiary. From this judgment he appeals to this court. The facts sufficiently appear in the opinion. '

The defendant having been charged with the murder of one Benjamin Ball, tried, and found guilty of murder in the second degree, brings the case here on appeal, and says the court below in the trial erred in the following particulars, as appears from the record filed in this court, to wit:
