MEMORANDUM OPINION AND ORDER

McBRYDE, District Judge.

This is a diversity action. Texas substantive law controls. Roberta McLaren (“McLaren”) is plaintiff, and Imperial Casualty and Indemnity Company (“Imperial”), Special Risks, Inc., (“Special”) and Russell Grace, Inc., (“Grace”) are defendants.
