OPINION

RICHARD BARAJAS, Chief Justice.

This is an appeal from a jury conviction for the offense of resisting a search. The court assessed punishment at six (6) months’ confinement in the county jail. We reverse and remand.

I. SUMMARY OF THE EVIDENCE

The jury heard from Bernard Kraft, a sergeant with the Midland Police Department, who testified that on April 10, 1997 at approximately 11:00 a.m., he went to an area of the city known as “The Flats” in anticipation of setting up a mobile police substation.
