Under the contract between appellee and appellant, appellee testifies that it was his business to give orders to Shaad, his assistant, and that he did so; that his relations with Shaad were such that he was manager and Shaad his assistant. He says: “ I was to give him instructions, and he obeyed them when he felt like it, and did not when he didn’t. On one occasion I did have a fisticuff row with my assistant. I gave him a slap in the face and he returned it, in front of the Abendpost. Afterward we had trouble, and I reported to Glogauer. He called Shaad up,…
