MEMORANDUM OPINION AND ORDER
GETZENDANNER, District Judge:
This diversity action is before the court on defendants’ motion for summary judgment on Counts I through IX of plaintiff’s eleven-count First Amended Complaint. For the reasons stated below, the court grants defendants’ motion.
The three principals of plaintiff First Commodity Traders, Inc. (“FCT”) are Robert Gardner, Bruce Zins, and Robert Blankoph (collectively “GZB”). 1 Before incorporating FCT, GZB were principals of a New York brokerage firm.
