VAN PELT, District Judge.

Plaintiff, an Alabama corporation,, brings this action against defendant, a. Nebraska corporation, alleging by complaint and supplemental complaint, infringement by defendant of two United States Letters Patent, No. 2,696,785, issued to John Blue, and to which the name of Douglas Johnston was later added as a joint inventor and which has been assigned to plaintiff (herein called plaintiff’s first patent) and No. 2,771,846, issued to plaintiff as assignee of inventors Donelson B. Horton and Douglas Johnston (herein called plaintiff’s second patent).
