*479In an action, in effect, to recover damages for unjust enrichment, the plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Westchester County (Bellantoni, J.), dated September 24, 2003, as granted the motion of the defendant D&M Electrical Contracting, Inc., pursuant to CPLR 3211 (a) (5) and (7) to dismiss the complaint insofar as asserted against it.
Ordered that the order is reversed insofar as appealed from, on the law, with costs payable by the defendant D&M Electrical Contracting, Inc., the motion is denied, and the complaint is reinstated insofar…
