Leroy Williams, the appellant, was indicted on a three-count indictment for the following crimes: (1) Count I — unlawful possession of a controlled substance, in violation of § 20-2-70, Code of Alabama 1975 (repealed); (2) Count II — unlawful possession of drug paraphernalia, in violation of § 20-2-75, Code of Alabama 1975 (repealed); and (3) Count III — unlawful possession of an illegally manufactured alcoholic beverage, in violation of § 28-1-1, Code of Alabama 1975.
