Albert Lee Jefferson, the defendant herein, was indicted and convicted for the murder of Marion Morris Stone while robbing him, in violation of § 13A-5-31 (a)(2), Ala. Code 1975 (repealed 1981).1 Following a sentencing hearing, wherein the aggravating and mitigating circumstances of the case were considered and weighed, the jury recommended the death sentence by a vote of eleven to one.
