Two issues are raised on this appeal, one relating to the instructions on findings and the other to the propriety of the convening authority’s action on the sentence. They arose in the following manner. The accused was tried by a special court-martial convened at Camp Courtney, Okinawa, for the offenses of absence without leave and two specifications alleging assault and battery in violation of Articles 86 and 128 of the Uniform Code of Military Justice, 10 USC §§ 886 and 928, respectively.
