This appeal is before us on remand from the Supreme Court of Texas. David J. Sacks P.C. v. Haden, 266 S.W.3d 447 (Tex.2008) (per curiam). Having reinstated the summary judgment rendered in favor of appellee, David J. Sacks, P.C.
