On February 1, 1919, plaintiff and defendant Jacob J. Gruenewald entered into a written agreement for the sale of a farm and the personal property thereon. The agreed price was $72,000, of which $15,000 represented the purchase price of the personal property. Shortly thereafter, defendant received a deed and took possession of the farm, making a down payment of $24,500, and executing to' plaintiff a note in the sum of $47,500, securing it by a first mortgage on the farm.
