In the underlying action, Plaintiff Michael P. Whittingham alleges that Defendant Amherst College failed to promote him in the Admissions Office on account of his race and thereafter retaliated against him, all in violation of 42 U.S.C. § 1981, Title VII of the Civil Rights Act of 1964 and the Massachusetts Civil Rights statutes.
