This is an action of contract to recover for a loss, sustained when thieves broke and entered the plaintiff’s premises and carried away its goods, which, it was alleged, came within- an oral agreement of insurance, or an agreement to renew a policy, or a policy of insurance. The answer contained a general denial, and also alleged that the plaintiff did not comply with conditions precedent contained in the policy, especially the condition requiring a private watchman to be on duty within the premises at all *694times when not regularly open for business.
