SEVERENS, Circuit Judge.

This suit was commenced by the filing of a bill in the chancery court for Davidson county, Tenn. The complainants described themselves therein as “persons in business under the firm name and style of the Union Stockyards Company,” of Nashville, Tenn. The object of the bill was to obtain a decree for damages for the alleged breach of covenants, and for the recovery of certain lands described therein, because of the nonperformance of conditions subsequent contained in the deed under which the defendant held title to said lands, and also to obtain an injunction…
