MEMORANDUM
NEWCOMER, District Judge.
Plaintiffs instituted this action in the Philadelphia Court of Common Pleas alleging that Conrail and its employees engaged in a deliberate course of harassing conduct with a goal of causing plaintiff Charles Eierman to be discharged. Compensation for injuries is sought pursuant to the Federal Employer’s Liability Act, 45 U.S.C. § 51 et seq., and the Pennsylvania common law of intentional infliction of emotional distress.
