George Choate appeals from an order of the District Court dismissing his complaint. Choate’s complaint had alleged that the defendant, the Louisville & Nashville Railroad Company (hereafter “L” & “N”), had intentionally and recklessly inflicted emotional distress upon him by terminating his employment and subsequently refusing to reinstate him in accordance with a determination of the Public Law Board.
