The defendant company issued an insurance policy of perpetual duration in the sum of $1,500 on the dwelling house of the plaintiff. The property was damaged by a fire of which the defendant had a prompt notice, and within two days thereafter, one A. T. Cross who was the secretary, treasurer and a director of the company, visited the ruins and represented himself as the adjuster of the company; selected mechanics and material men to make estimates, and, the plaintiff contends, did then and there adjust and compromise the loss at $461.83, and in the name of the company…
