MEMORANDUM-DECISION and ORDER
HURD, District Judge.
I. Background
Petitioner Steven DiGrado (“petitioner” or “DiGrado”) is a native and citizen of Italy who, at the age of seven, entered the United States as an immigrant with his parents in 1966. (See Pet. at ¶ 1.) DiGra-do, who never applied for citizenship in this country, subsequently married and had two children. Id. at ¶¶ 1-2.
On June 23, 1993, DiGrado was arrested and thereafter charged with possessing with intent to distribute more than 500 grams of heroin. Id. at Ex. A. DiGrado pleaded guilty to this charge and was sentenced by the Hon.…
