1Opinion of the CourtCarter, J.
Plaintiff, a chartered city, enacted an ordinance pertaining to rubbish. It provides that rubbish includes *96combustible and noneombustible material.* Every person having “charge or control” of any place where any rubbish accumulates shall cause it to be placed in specified receptacles and shall not permit it to accumulate for over certain periods of time (combustible — one week; noncombustible — one month).
