BACKGROUND
This is an action under the National. Environmental Policy Act of 1969, as amend ed, (“NEPA”), 42 U.S.C. §§ 4321 to 4347, 1 challenging the defendants’ decision to allow the Pennsylvania Army National Guard Aviation Support Facility and Company G, 104th Aviation (“104th Aviation”) 2 to relocate its training base to the Mid-State Airport (“Mid-State”) near Phillips-burg, Pennsylvania.
