Before this court is Plaintiffs “Motion for Declaratory Judgment that Defendant’s Offer of Judgment is Null and Void as Contrary to Federal Law” filed on March 28, 1995. Defendant filed a response to Plaintiffs motion on April 7,1995. Subsequently, Plaintiff filed a reply to Defendant’s response on April 13, 1995.
