Between 7:00 and 8:00 P. M. on Saturday, June 2, 1956, Mrs. Margaret Allen Coker, a pedestrian, was struck and killed by a 1955 Chevrolet automobile. Ben Mouzon and John Bryant, Jr., both Negroes, were riding in the front seat, but there is a dispute as to which one was driving. Both *658were indicted. Ben Mouzon was convicted of murder with recommendation to mercy and given a life sentence. John Bryant, Jr., was convicted of accessory after the fact of murder and sentenced to imprisonment for a term of five years. Only Ben Mouzon has appealed.
