Plaintiff in error, Prince Owen, appeals from a conviction of murder in the second degree of Jarele Marie Tidwell and Mrs. Robert Elvie Hicks whose deaths *461resulted from being run into by a truck as they walked along the shoulder of Highway No. 45 in Henderson County between 11:00 and 11:30 on the night of May 10, 1947. The first question made by the assignments of error in support of his appeal is that the evidence preponderates against the verdict.
