Moss, Justice.

The Grand Jury of Orangeburg County did, on September 15, 1958, at a Court of General Sessions, return an in dictment charging William Otis Britt and Douglas West-bury, the appellants herein, along with Lee von Tilson, with the murder of Harry Boyd Ray, it being asserted that the homicide occurred in Orangeburg County on September 7, 1958. The three were duly arraigned upon such indictment and entered a plea of “Not Guilty”. A motion for a continuance was made and granted at the 1958 September term of Court.
