State v. Mbacke
Supreme Court of North Carolina
1Opinion of the Court
EDMUNDS, Justice.
In this case, we consider whether the search of defendant Omar Sidy Mbacke’s automobile following his arrest for carrying a concealed gun violated his Fourth Amendment right against unreasonable *404searches and seizures. Because it was reasonable for the arresting officers to believe that they might find evidence of the offense of arrest in defendant’s vehicle, we conclude that defendant’s rights were not violated. Accordingly, we reverse the Court of Appeals decision and instruct that court to reinstate the trial court’s denial of defendant’s motion for appropriate relief.
