ERVIN, Justice.

*159 **364 The question before us in this case is whether the record supports the trial court's decision to deny defendant's motion for appropriate relief. After carefully considering the record in light of the applicable law, we hold that, while the claim asserted in defendant's motion for appropriate relief is not subject to the procedural bar established by N.C.G.S. § 15A-1419(a)(3), the trial court did not err by denying defendant's motion for appropriate relief for the reasons stated by the Court of Appeals.
