Defendant was charged by indictment with the sale of heroin, in violation of section 11501 of the Health and Safety Code. Trial by jury was duly waived and the matter was submitted on the transcript of the testimony before the grand jury, supplemented by additional oral testimony. Defendant was found guilty as charged. Pursuant to then section 6451 of the Penal Code, 1 the criminal proceedings were suspended and proceedings looking toward defendant’s commitment to the California Rehabilitation Center were begun.
