Taylor, J. :

Carrie H. Cunningham, the appellee, on the 27th of April, 1886, filed her bill in equity in the Circuit Court for Orange county against William Boswell and A. J. Rose, as copartners under the firm name of Boswell & Rose, and against Rosa A. Rose, wife of A. J. Rose, and John M. Bryan.

The substantial allegations of the bill were as follows: That on the 19th of March, 1886, the complainant, being desirous of purchasing a certain parcel of land containing two acres, situated in Kissimmee City, in (what was then the territory of) Orange county, and known as Block M in Patrick’s…
