Plaintiff sued to recover the damages which it alleged were sustained by reason of defective work in the construction of a sewer in Madison Avenue in the City of Allegheny, now a part of the City of Pittsburgh, along the side of the property owned by plaintiff, and for a negligent failure to keep the sewer in repair, after notice that it was in need thereof.
