Meredith, Judge:

This is an action of assumpsit brought by the Flat Top' National Bank of Bluefield against A. F. Parsons in the Circuit Court of Cabell County, to April rules, 1921, and was tried before a jury on the 20th, 21st and 23rd days of May following. There are four counts to the declaration, the first being indebitatus assumpsit; the second, a special count upon a note executed by the defendant payable to the order of one, C. T.
