Dent, Judge:
Dewing & Sons appeal from a decree- of the circuit court of Randolph County in a chancery suit wherein they were plaintiffs and Elihu Hutton and others were defendants.
This suit was here before with the shoe on the other foot, and is reported in 40 W. Va. 521, where the origin of the litigation is fully detailed, and it is not necessary to repeat it. At that time Dewing & Sons had a decree against Hutton for the sum of thirty-nine thousand dollars, and Hutton was dissatisfied.
