{¶ 1} This appeal challenges a denial of a motion for summary judgment issued by the Mahoning County Court of Common Pleas. Appellant, YSD Industries, Inc., filed its motion for summary judgment on the issue as to whether appellee, Carl Chieffo, was entitled to participate in the workers’ compensation fund for the condition of asbestosis. After the court denied appellant’s motion, the case went to trial, and a jury rendered a verdict in favor of appellee.
