A jury convicted defendant of aggravated sexual assault, rejecting his defense that the victim consented to have sexual relations with him. In a split decision, the Appellate Division affirmed. We must determine whether the trial court properly applied the Rape Shield Statute, N.J.S.A. 2C:14-7, in excluding evidence of the victim’s past relationship with defendant. Defendant claims that the excluded evidence would have explained the events leading to the sexual encounter and to the victim’s consent and, therefore, was critical to a fair trial.…
