Upon the former hearing of this cause we held that the judgment in favor of William E. Atwater was invalid, and that he acquired no lien upon the assets of Klemm & Co. by virtue of the levy of execution under that judgment. We see no reason for retreating from that conclusion, nor is any fault found with it by the petition for rehearing filed herein. No rehearing has been asked for by Atwater, or by any of the other creditors, except The American Exchange National Bank of Chicago. The Bank, whose petition for rehearing has never been replied to by any of the other parties, asked a rehearing…
